PART I PRELIMINARY

This Ordinance may be cited as the Money Lenders Ordinance.
This Ordinance shall have effect notwithstanding any agreement

PART II LICENSING OF MONEY LENDERS

No person shall carry on business as a money lender--
without a licence;
at any place other than the premises specified in such licence;
or

A licence shall be in the prescribed form.
pplication for licence and public notification of application
An application for a licence shall be made to the Registrar in

Licensing court
Where an application is lodged under section 9 (5), the

For the purposes of hearing and determining an application

r section 9 (5), the licensing court shall be constituted by-

1 (2) (b) (i), subject to subsection (3), a magistrate sitting

where a notice has been served on the applicant under section 9
(4) or
2) (b) (i), a magistrate sitting with 2 assessors.
Without limiting the generality of the power of the licensing
court

r section 9 (5), the licensing court shall, where--
it is constituted by a magistrate sitting alone; and
it grants leave under section 11 (2) (b) (ii) to a person to object

Selection of assessors and payment of fees to assessors
Where under this Ordinance the licensing court is required
to be

为了提高工人队伍素质,确保生产、工作的需要,根据国务院一九七八年《关于工人退休退职暂行办法》的规定和国务院一九八三年《关于认真整顿招收退休、退职职工子女工作的通知》精神,特制定本办法。
一、招收原则
招收退休工人子女要经过德智体全面考核,择优录取。市属单位由各区、县、局(总公司),中央在京单位由主管部门(以下简称主管部门)根据生产、工作需要,统筹安排,并实行先退休后招收的原则。
二、招收范围
凡是符合《关于认真整顿招收退休、退职职工子女工作的通知》第三条规定的正常退休的工人,已经办理了退休手续的,可以申请招收一名当年符合招工条件的子女参加工作。退休工人独身在京,子女户口在农村的,退休工人必须把本人户口迁回农村后,才可以招收一名符合招工条件
的子女。对非因工作需要而延期退休的,不得招收其子女。对退休工人及其配偶都是城镇户口的,不得招收其在农村的子女。
三、招收条件
招收退休工人子女的条件为:具有初中毕业及以上文化程度、身体健康,本人政治思想表现较好,年龄为十七周岁至二十五周岁的未婚青年。
特殊行业如矿山井下、野外地质勘探、架线、筑路、清除粪便、排污、送煤等工种,招收退休工人子女的年龄可放宽到三十周岁,文化程度可放宽到高小毕业。
四、招收计划
主管部门应本着统筹安排、合理使用的原则,于每年年初提出本部门招收退休工人子女的计划,报市劳动局审查批准后执行。原则上应该是当年退休,当年招收。当年已经搞完招收工作以后退休的工人,其符合招收条件的子女可以保留报名和考试权利到第二年。
招收计划应包括:(1)计划退休的人数。(2)招收退休工人子女的人数。(3)招收后分配的单位。(4)由于生产上的需要,招收退休工人子女对男女比例有特殊要求的,由主管部门提出,报市劳动局批准。
五、报名
经批准并办理了退休手续的工人,可向本单位申请招收自己的一名子女,并填写《报名登记表》,经本单位组织审查,符合招收条件的,准予报名。
六、考核
经批准报名的家居本市并具有城镇常住户口的退休工人子女,由各主管部门每年一次或分几次招收。每次都要集中进行德、智、体的考核。首先进行“智”的考核,即文化考试。由主管部门统一命题、印卷,统一组织考试,统一阅卷判分,确定录取分数线,并公布考试结果。达到录取
分数线的,再进行政治思想表现的考察,并由主管部门指定医院进行体检。
家居农村和外地的子女如何考核,由各主管部门确定。
七、录取
主管部门根据每个人的德、智、体考核结果,决定是否录取。由于男女比例的限制,符合招工条件的一部分男性或一部分女性退体工人子女不能被录取的,当年内可以再保留一次报名和考试的权利。
八、审批手续
退休工人子女被录用后,由录用单位填写《招收退休工人子女审批表》,经主管部门审查,并加盖公章,然后连同本人户口簿学历证明、父亲(母亲)退休证,一并送本人户口所在区、县劳动局(科)审核无误,办理招工录用手续。被招收的退休工人子女是农村户口和外地的,要报本
人父(母)原工作单位所在区、县劳动局(科)审核同意,办理招工录用和户口转迁手续。
九、签订劳动合同
退休工人子女被录用后,一律按照市劳动局〔83〕市劳服字第166号文件的规定,与录用单位签订劳动合同。
十、试工期
退休工人子女被录用后,一律实行半年的试工期制度。录用后半年内录用单位如发现本人不符合招工条件或患有慢性疾病不能坚持正常工作的,可将本人和他的档案退回户口所在地区,原地区应予接收。从外地或农村录用的,连同户口一并转回外地或农村。
十一、工作分配
退休工人子女被录用后,录用单位应对他们进行职业道德、安全、纪律等方面的教育,然后按照生产、工作需要、本人志愿,本着择优分配、量材使用的原则,分配工作。
十二、附则
本办法自公布之日起执行,本市过去的有关规定与本办法不符的,一律停止执行。
本办法的解释权属于北京市劳动局。
